Keeping your benefits during the appeal

To keep your services the same until the hearing decision, ask for a hearing before the Date of Action on your notice and check the box to continue services. If you ask no more than 10 calendar days after the Date of Action, Nevada Medicaid may reinstate your services; it must reinstate them if it did not send the required advance notice. For eligibility (DSS) cases, the written request must be received by the 10th day after the effective date of the action. If you lose, Medicaid may ask you to pay back the cost of continued services.

When the hearing is held

Within 10 calendar days of a standard hearing request, Nevada Medicaid offers an optional Hearing Preparation Meeting by phone (held within 21 working days) to try to resolve the issue. You get at least 10 calendar days' notice of the hearing. The decision is due within 90 calendar days of the request.

Faster (expedited) hearing

Check the expedited box on the request form and attach your provider's medical documentation showing that a standard hearing could jeopardize your life, health or ability to attain, maintain or regain maximum function. Expedited hearings are by phone, and the decision is due no later than 3 working days after the Hearings Office receives the request.
