Keeping your benefits during the appeal

When you appeal, say that you want "continuing benefits." For Medicaid or Dr. Dynasaur you must appeal before the date your coverage ends or the date your payment changes. If you lose, you may have to pay back the cost of care you got that you did not qualify for.

When the hearing is held

After you appeal, the Human Services Board sends you a letter about next steps. The appeal must be decided within 90 days in most cases.

Faster (expedited) hearing

If waiting would hurt you, ask for a fast (expedited) appeal the same ways you file. Most expedited appeals are decided within 7 working days; Medicaid for people who are aged, blind or disabled and long-term care appeals may take longer.

Medicaid health plan (managed care) in Vermont

Appeal to the plan first

For a denied, reduced or ended Medicaid service (such as a procedure, prescription or equipment), first ask the department that made the decision for an internal appeal within 60 calendar days of the decision, using the Request for Internal Appeal form, by phone or by mail to the Health Care Appeals Team, Department of Vermont Health Access, 150 Pilgrim Park, Waterbury, VT 05676. If your services are ending or being reduced, ask that they continue during the appeal. DVHA decides within 30 days (it can take 14 more days if that helps you or you ask). If you lose, you have 120 days from the date on the decision letter to ask the Human Services Board for a fair hearing. After an expedited internal appeal you can ask for a fast fair hearing.

If the plan is late

If DVHA misses its deadline to decide your internal appeal, you do not have to keep waiting and can ask for a fair hearing.
