- If you are late
The 30-day period can be extended if you show good cause, as decided by the Division of Medicaid, as long as the facts of your case have not changed. Without good cause, a late request is not accepted, but you can reapply.
- How to ask for a hearing
- Mail: A simple signed letter asking for a hearing is enough. Mail it to the Medicaid regional office shown on your notice or to the state office: Mississippi Division of Medicaid, P.O. Box 2222, Jackson, MS 39225. Forms: DOM 350 (Request for Local Hearing) or DOM 352 (Request for State Hearing).
- Phone: Call the Medicaid regional office shown on your notice (or the Office of Eligibility, 1-800-421-2408). Staff fill out the hearing request form for you.
- In person: At the Medicaid regional office shown on your notice; staff help you fill out the form.
- Online: The Division of Medicaid also accepts hearing requests through other commonly available electronic means sent to the regional office shown on your notice.
- Mail address
Mississippi Division of Medicaid, P.O. Box 2222, Jackson, MS 39225 (or your regional office)
- What to include
A simple signed statement asking for a hearing is enough. If you can, give the reason and say whether you want a local hearing, a state hearing, or both. If you do not say, the regional office will contact you, and if it cannot reach you within 3 days it schedules a local hearing.
- Keeping your benefits during the appeal
If you already have Medicaid or CHIP, your benefits continue at the old level if the regional office receives your hearing request within 10 days of the date of the notice. A request received after that is not timely for keeping benefits. If you lose, the Division of Medicaid may recover the cost of services you got only because benefits continued.

- When the hearing is held
You can ask for a local hearing, a state hearing, or both. Disability or blindness decisions and Katie Beckett level-of-care decisions go straight to a state hearing. Hearings are usually by phone. The hearing notice is mailed at least 5 days before the hearing. The Division of Medicaid must take final action within 90 days of your first hearing request. After an adverse local decision, the state hearing request must reach the regional or state office within 15 days of the postmark date of the local decision; benefits that were continued keep going if you ask within those 15 days.

- Faster (expedited) hearing
If you are uninsured and need a medical procedure or treatment that is scheduled or needs to be scheduled, you can ask your Medicaid regional office for an expedited hearing in person, by mail, by phone or by other electronic means. If it is granted, the decision is due within 7 working days; if not, the standard 90-day timeframe applies.

Medicaid health plan (managed care) in Mississippi
- Appeal to the plan first
If you are in a MississippiCAN or CHIP managed care plan (coordinated care organization), you must finish the plan's appeal process first, then you can ask the Division of Medicaid for a state fair hearing if the plan says no. Federal managed care deadlines apply.
