How each deadline is counted in Iowa

Time to file

Iowa law does not set a longer time to file a grievance than the federal rule (at least 180 days for most plans). The deadline that applies to you is on your denial notice.

Law: Iowa Code 514J.106(2)

Deadline to ask

File your written request with the Iowa Insurance Division within 4 months after you receive the final adverse determination (or within 4 months after the carrier missed its 30-day grievance deadline or agreed to skip the internal process).

Law: Iowa Code 514J.106-514J.110, 514J.115; Iowa Code 191 IAC 76

The deadline runs from

The date you receive the final adverse determination (or 30 days after filing a grievance with no written decision, or the date the carrier agreed to skip the internal process)

Hearing deadline

The date of the notice of the action being appealed.

Keeping your benefits during the appeal

Your Medicaid may continue while you appeal if you file before the effective date on the notice, or within 10 days after you receive the Notice of Decision.

If you miss a deadline

Medicaid

If you file more than 30 days but less than 90 days after the date of the notice, HHS may still grant a hearing at its discretion if you show good cause, such as a serious illness or death in the family, a family emergency or disaster, or not receiving the notice for a reason beyond your control (not telling HHS you moved does not count). Send a written explanation with proof to HHS Appeals. HHS's How to Appeal page lists 90 days for Medicaid appeals.
