How each deadline is counted in Utah

Time to file

Utah law does not set a different time to file. Use the deadline on your denial notice; federal rules give at least 180 days for most plans.

Law: Utah Code 31A-22-629(3), (5)(b); Utah Admin. Code R590-261-4

Deadline to ask

You have 180 calendar days after you receive the carrier's final denial to send your request to the Utah Insurance Department. If you send it to the carrier by mistake, the carrier must forward it to the Department within 1 business day.

Law: Utah Code 31A-22-629; Utah Admin. Code R590-261-6, -8, -9, -10, -11

The deadline runs from

The date you receive the notice of the final adverse benefit determination (the carrier's final internal appeal decision)

Deadline for service decisions

The date the Medicaid agency sent its denial notice (decisions about services by the Medicaid agency). For Medicaid or CHIP eligibility decisions the deadline is 90 days from the date on the notice.

Deadline for eligibility decisions

The date on the eligibility notice you disagree with (if the 90th day is not a business day, the next business day)

Keeping your benefits during the appeal

Services: send the hearing form and a signed request to continue services within 10 calendar days of the date the Medicaid agency's notice was sent (or after the plan sent its appeal decision).
