- Deadline to ask
4 months

- The deadline runs from
The date you receive the insurer's denial (final internal appeal decision)
- Do I have to appeal to my plan first?
In most cases you must first finish your plan's internal appeal. You do not have to if you and the insurer agree to go straight to external review, or if you need immediate care and waiting for the internal appeal could jeopardize your life or health. Call OID before sending your papers in an urgent case.
- Cost
There is no cost to you. Your health plan pays the review organization's fees.
- What can be reviewed
Decisions based on medical necessity, appropriateness, health care setting, level of care or effectiveness, including denials of experimental or investigational treatment. There is no minimum claim amount. Not eligible: services the policy clearly excludes, administrative issues (such as late premiums), Medicare, Medicaid, other federal plans and most self-funded employer plans.
- Is the decision final?
The review organization's decision is binding on your health plan.
- How to ask
Send the signed and dated External Review Request Form, a copy of your insurance ID card, and the internal appeal denial letter to: Oklahoma Insurance Department, External Review, 400 NE 50th Street, Oklahoma City, OK 73105, or by fax to 405-521-6652. Attach any information from your insurer about the denial and anything from your doctor you want considered. You can name an authorized representative, including your provider. Once the request is found eligible and a review organization is assigned, it has up to 45 days to decide.
