External review in Nebraska: deadline, cost and how to ask

Nebraska runs its own independent review of denials: External Review (Health Carrier External Review Act). You generally have 4 months to ask for it.

External review means a doctor or reviewer outside your plan decides again. Internal appeal means your plan looks at its own decision again.

Checked against official sources: October 30, 2026.

Appeal deadlines are strict. If you are near a deadline or your care is urgent, call free help today.

Step 2: Outside review in Nebraska

Program

External Review (Health Carrier External Review Act)

Who runs it
  • Nebraska Department of Insurance (assigns an independent review organization): Insured health plans and HMOs regulated in Nebraska
Deadline to ask

4 months

You must file within 4 months after you receive the denial notice.

The deadline runs from

The date you receive the notice of the adverse determination or final adverse determination (denial)

Do I have to appeal to my plan first?

You usually must finish the plan's internal grievance process first. You are treated as having finished it if the plan has not given you a written decision within the time the law allows (unless you agreed to a delay), or if the plan waives the requirement. For urgent cases and experimental-treatment denials your doctor certifies as urgent, you can ask for expedited external review at the same time as an expedited internal review. For denials of care you already received (retrospective review), you must finish the internal process.

Cost

External review is free for you. The health plan pays the cost of the independent review organization.

What can be reviewed

Denials because care does not meet the plan's requirements for medical necessity, health care setting, level of care or effectiveness, and denials because a treatment is experimental or investigational. Denials for other reasons, such as an out-of-network provider, a contract exclusion or an unmet deductible, are not eligible. Limited policies (dental, vision, specified disease, hospital indemnity, long-term care, Medicare supplement) are not covered.

Is the decision final?

The decision is binding on the plan and on you, except where either has other remedies under state law (or federal law for you). You cannot ask for a second external review of the same denial.

How to ask

Apply online through the NDOI External Review Secure Portal, which lets you track your case and sends you emails, or mail the paper External Review Form to Nebraska Department of Insurance, PO Box 95087, Lincoln, NE 68509-5087 (fax 402-471-4610). Include: the signed and dated form; a copy of your insurance ID card; the plan's letter saying its decision is final (or that it waived the internal process); and your certificate of coverage or benefit booklet (or your member ID number). For an expedited or experimental-treatment review, your doctor completes the matching form or answers through the portal.
